Certificates of Occupancy

A building or structure hereafter constructed shall not be used or occupied in whole or in part until a certificate of use and occupancy had been issued by the appropriate enforcing agency.

A building or structure shall not be used or occupied, and a change in the existing occupancy classification of a building or structure or portion thereof shall not be made until a certificate of occupancy has been issued.

It is unlawful to use or occupy a structure without a Certificate of use and Occupancy under the Michigan compiled law. (125.1513)

Applying for a Temporary or Full Certificate of Occupancy

When applying for a Certificate of Occupancy, there are certain conditions that must first be met prior to actually submitting your application. Applications may be submitted ONLY after the following conditions have been met:

1. All required inspections have been done and approved.

2. Zoning compliance from township (if required) has been done and approved.

3. Certificate of Insulation affidavit for any blown cellulose insulation from the installer must be submitted to Livingston County Building Department.

4. Livingston County Environmental Health final approval – (well and/or septic system).

5. All outstanding fees must be paid in full.

6. An additional fee of $50 for a Temporary Certificate of Occupancy is accrued.

7. Reason for applying for a Temporary Certificate of Occupancy – (reviews are done on a case-by-case basis) has been clearly stated.

The Certificate of Occupancy (CO) application must be completed by either the homeowner or contractor of a building project. A minimum of 48 hours processing time from the date of the application is generally necessary. The Livingston County Building Department will call you when the CO is ready for pickup. Failing to provide or complete any of the requirements for a CO will result in delay
