Probate Court has jurisdiction and supervision in the administration
of estates and trust of deceased persons. The Court also hears cases
pertaining to guardianships; conservatorship for adults and minors; the
commitment for hospitalization and or treatment of mentally ill persons,
the mentally handicapped, and addicted persons. The Probate Court
follows the rules outlined in the Estates and Protected
Individuals Code (EPIC) that took effect on April 1, 2000.
ESTATES
- The interest a person has in real or personal property;
property left when a person dies. When an individual dies there are different ways to
proceed with an estate:
Guardianship - the
appointment of a person who has the legal duty and power
to take care of the person of another, who, because of some
disability, usually age or incompetence, is considered incapable
of caring for himself or herself.
Conservatorship -a
person appointed by the court, as provided in the EPIC to manage
and protect the estate finances of a minor or person
under legal disability because of mental illness, mental
deficiency of physical illness or disability. R
Mental Illness
- a substantial disorder of thought or mood
which significantly impairs judgment, behavior, capacity to
recognize reality, or ability to cope with the ordinary demands
of life.
**NOTE: Pursuant to Local Administrative Order 2004-02
the only pleadings accepted via facsimile in the Livingston
County Probate and 44th Circuit Courts are pleadings regarding
Mental Health Code proceedings.
Wills - a
written instrument whereby a person makes a disposition of his
or her property to take effect after his or her death.
