Recent Cases of Interest - 2003
On December 10, 2003, a Circuit Court jury found
Defendant Steven Charles Oliver guilty of Operating
Under the Influence of Intoxicating Liquor - Third
Offense for an incident in Green Oak Township on March
10, 2001. He was sentenced to serve a term of 18 months
to 5 years in the Michigan Department of Corrections by
the Hon. Daniel A. Burress on January 29, 2004. The case
was prosecuted by Bill McCririe.

On November 4, 2003, Brian Michael Marsland was
found guilty of Operating Under the Influence of Liquor
- Third Offense and Operating Without Insurance after a
bench trial for an incident on January 15, 2003 in
Tyrone Township. Marsland was sentenced as an Habitual
Offender to three years probation with the first year in
the Livingston County Jail by the Hon. Daniel A. Burress
on December 11, 2003. The case was prosecuted by Shawn
Ryan.

On October 23, 2003, a District Court jury found
Kevin Wayne Ronan guilty of Domestic Violence for an
incident in Pinckney on July 21, 2003. The case was
prosecuted by Jim Metz.

On October 22, 2003, the Michigan Court of Appeals
entered an order in an appeal filed by the Livingston
County Prosecutor’s Office. The Court of Appeals
reversed the Livingston County Circuit Court and
reinstated Manslaughter charges against John Franklen
Ford for an incident occurring on August 21, 2003 at the
Lake Chemung exit in Genoa Township. The case was
remanded for trial. The appeal was handled by Bill
Vailliencourt.

On October 16, 2003, the Michigan Court of Appeals
affirmed the convictions of Damon Dean Tinsley for two
counts of First Degree Criminal Sexual Conduct arising
out of incidents occurring from 1994 through 1996. In a
case tried by Pam Maas in January of 2002, Tinsley was
found guilty by a jury and was sentenced to serve 25-60
years in prison by the Hon. Stanley J. Latreille. The
case was briefed for the Court of Appeals by Pam Maas
and argued by Bill Vailliencourt.

On October 16, 2003, on remand from the Michigan
Supreme Court, the Michigan Court of Appeals issued an
opinion in the case of Dennis Michael Perks. The opinion
clarifies Michigan law by restricting the ability of
probation violators to file automatic appeals. The
appeal was handled by Bill Vailliencourt.

On October 8, 2003, Elick Michael Verdulla was
sentenced to serve 27-50 years in the Michigan
Department of Corrections by the Hon. Stanley J.
Latreille. Verdulla pled guilty to Second Degree Murder,
Possessing a Firearm in the Commission of a
Felony-Second Offense, Felon in Possession of a Firearm,
and Habitual Offender-Fourth on September 5, 2003 for an
August 29, 2002 incident in Fowlerville. The case was
prosecuted by David Morse.

On October 2, 2003, Patrick Allen McKillen, Jr. was
sentenced to serve 30-60 years in the Michigan
Department of Corrections by the Hon. Daniel A. Burress.
McKillen pled guilty to two counts of Armed Robbery, two
counts of Possessing a Firearm in the Commission of a
Felony, Felon in Possession of a Firearm, Discharge of a
Firearm In a Building, and Habitual Offender-Fourth on
August 11, 2003 for incidents occurring on March 17,
2002 in Hamburg Township and Putnam Township. The cases
were prosecuted by Shawn Ryan.

On October 2, 2003, a District Court jury found
Gregg Scott Young guilty of Operating While Impaired-2nd
Offense for an incident in Brighton Township on June 21,
2003. The case was prosecuted by Angela DelVero.

On October 1, 2003, a Circuit Court jury found Anish
Thomas guilty of Attempting to Distribute Obscene
Material to a Minor and Using a Computer to Attempt to
Distribute Obscene Material to a Minor arising out of an
incident on June 27, 2003 investigated by Livingston
County Sheriff Department's Computer Crime Unit. He was
sentenced to three years of probation with the first 180
days in the Livingston County Jail by the Hon. Daniel A.
Burress on October 23, 2003. The case was prosecuted by
Pam Maas.

On September 25, 2003, a District Court jury found
Jason Matthew Holdwick guilty of Assault and Battery for
an incident in Conway Township on March 30, 2003. The
case was prosecuted by Suzanne Geddis.

On September 19, 2003, a Circuit Court Jury found
Defendant Gary James Flannigan, Jr. guilty of Bank
Robbery and Possessing a Firearm in the Commission of a
Felony for the December 28, 2001 robbery of the First
National Bank in Brighton Township. He was sentenced to
19-30 years, plus an additional 2 years for Felony
Firearm, in the Michigan Department of Corrections as an
Habitual Offender-Fourth by the Hon. Stanley J.
Latreille on October 28, 2003. The case was prosecuted
by Pam Maas.

On September 18, 2003, the Michigan Court of Appeals
affirmed the convictions of Timothy Allen for Felony
Murder, Possessing a Firearm in the Commission of a
Felony, First Degree Home Invasion, and Assault With
Intent to Do Great Bodily Harm arising out of the July
19, 2000 killing of Kirk Williams in Hartland Township.
In a case tried by David Morse in January of 2002, Allen
was found guilty but mentally ill by a jury and was
sentenced to life in prison by the Hon. Stanley J.
Latreille. The appeal was handled by Bill Vailliencourt.

On September 16, 2003, a Circuit Court jury found
Defendant Loren James Tompkins, Jr. guilty of First
Degree Retail Fraud for an incident at Wal-Mart in Genoa
Township on April 6, 2003. He was sentenced to serve 27
months - 10 years in the Michigan Department of
Corrections as an Habitual Offender Third by the Hon.
Daniel A. Burress on November 13, 2003. The case was
prosecuted by Bill McCririe.

On September 11, 2003, a District Court jury found
Mark Michael Simpson guilty of Assault and Battery for
an incident in Pinckney on May 24, 2003. The case was
prosecuted by Jim Metz.

On September 11, 2003, the Michigan Court of Appeals
affirmed the conviction of Craig Mooney on two counts of
First Degree Criminal Sexual Conduct and one count of
Felonious Assault. In a case tried by Pamela Maas before
the Hon. Daniel A. Burress in April of 2001, Mooney was
tried and convicted by a jury and sentenced to serve 13
to 20 years in the Michigan Department of Corrections.

On September 2, 2003, a District Court jury found
Defendant Kyle Scott Seyfried guilty of Domestic
Violence for an incident in Hamburg Township on June 13,
2003. The Hon. Michael Hegarty sentenced Defendant to
two years of probation with the first thirty days in the
Livingston County Jail. The case was prosecuted by
Angela DelVero.

On August 15, 2003, a Circuit Court jury found
Defendant Craig Michael Haskell guilty, but mentally
ill, of four counts of First Degree Criminal Sexual
Conduct, one count of Second Degree Criminal Sexual
Conduct, and one count of Aggravated Domestic Violence,
for an attack in Green Oak Township on May 17, 2002. He
was sentenced to 12-30 years in the Michigan Department
of Correction by the Hon. Daniel A. Burress on October
2, 2003. The case was prosecuted by Pamela Maas.

On August 14, 2003, a District Court jury found
Defendant Michael David McCreary guilty of Assault and
Battery for an incident in Cohoctah Township on April
20, 2003. He faces a maximum sentence of 93 days in jail
when he is sentenced by the Hon. A. John Pikkarainen on
September 15, 2003. The case was prosecuted by Jim Metz.

On August 12, 2003, the Hon. Stanley Latreille
sentenced Austin England to a term of 30-60 years in the
Michigan Department of Corrections for the August 3,
2002 murder of his wife in Fowlerville. England pled
guilty to a charge of Second Degree Murder on July 8,
2003. The case was prosecuted by Pamela Maas.

| On August 6, 2003, a Circuit Court jury found
Defendant Ryan Kendrick Nichols guilty of Kidnapping,
Assault With Intent to Commit Great Bodily Harm Less
Than Murder, and Possession of a Firearm During the
Commission of a Felony for an incident in Iosco Township
on December 9, 2001. He was sentenced to serve 17-40
years in the Michigan Department of Corrections by the
Hon. Daniel A. Burress on September 18, 2003. The case
was prosecuted by Suzanne Geddis.
