Recent Cases of Interest - 2007

 
On November 7, 2007, a Circuit Court jury found Louis Carlos Sampey guilty of Receiving and Concealing Stolen Property Over $1,000 and Receiving and Concealing Stolen Property Less than $200 for an incident on April 11, 2007 in Conway Township. Facing a maximum sentence of five years in prison, Sampey was sentenced to serve 18 months probation by the Hon. David J. Reader on December 20, 2007. The case was prosecuted by Shawn Ryan.
On October 25, 2007, a Circuit Court jury found Edward Ford Garland guilty of two counts of First Degree Criminal Sexual Conduct, two counts of Third Degree Criminal Sexual Conduct, and one count of First Degree Home Invasion for an incident on May 22, 2005 in Genoa Township. Garland was sentenced to serve 15-40 years in prison as a second habitual offender by the Hon. David J. Reader on December 20, 2007. The case was prosecuted by Pam Maas.
On August 7, 2007, the Michigan Court of Appeals affirmed the convictions of John Richard Tyler for three counts of Second Degree Criminal Sexual Conduct. In a case tried by Pam Maas before the Hon. David J. Reader in October of 2005, Tyler was convicted by a jury and sentenced to serve 71 months - 15 years in prison. The appeal was prosecuted by Bill Vailliencourt.
On August 15, 2007, a Circuit Court jury found Robin Elaine Albright guilty of Operating While Intoxicated - Third Offense and Failing to Report an Accident for an incident on January 16, 2007 in Tyrone Township. Albright was sentenced to serve two years probation with the first 30 days in the Livingston County Jail by acting Circuit Judge A. John Pikkarainen on October 12, 2007. The case was prosecuted by Angela DelVero.
On June 26, 2007, a Circuit Court jury found Virgil Miclea guilty of Possession of Marijuana With Intent to Deliver and Driving While License Suspended - Second Offense for an incident on October 4, 2006 in Brighton Township. Miclea was sentenced to serve 30 months to 15 years in prison as a Fourth Habitual Offender by the Hon. Stanley J. Latreille on August 23, 2007. The case was prosecuted by Angela DelVero.
On June 7, 2007, the Michigan Court of Appeals affirmed the conviction of Jason Frank Baumgartner for Operating a Motor Vehicle While Visibly Impaired Causing Death. In a case tried by Bill McCririe before the Hon. Daniel A. Burress in March of 2004, Baumgartner was convicted by a jury and sentenced to serve 3-1/2 - 15 years in prison. The appeal was prosecuted by Bill Vailliencourt.
On June 1, 2007, the Court of Appeals issued an order in an appeal filed by the Livingston County Prosecutor’s Office in the case of the People v Edward Franklin Hulbert. For the second time in this case, the Court of Appeals reversed the sentence imposed by the Hon. David J. Reader of the Livingston County Circuit Court below sentencing guidelines after Hulbert’s violation of probation for Assault With Intent to Commit Sexual Penetration. The Court of Appeals order remanded the case to Circuit Court for resentencing before a different judge. The appeal was prosecuted by Bill Vailliencourt.
On May 22, 2007, the Michigan Court of Appeals affirmed the convictions of Tad Spencer Dewulf for Interfering with a Police Investigation and Assault and Battery. In a case tried by Jim Metz before the Hon. Daniel A. Burress in May of 2004, Dewulf was convicted by a jury and sentenced to serve 9 - 30 years in prison as a Fourth Habitual Offender. The appeal was prosecuted by Bill Vailliencourt.
On April 24, 2007, the Court of Appeals issued an opinion in an appeal filed by the Livingston County Prosecutor’s Office in the case of the People v Robert William Duke. The Court of Appeals reversed a sentence imposed by the Hon. David J. Reader of the Livingston County Circuit Court below sentencing guidelines after Duke’s conviction for First Degree Home Invasion. The Court of Appeals opinion remanded the case to Circuit Court for resentencing. The appeal was prosecuted by Bill Vailliencourt.
On March 27, 2007, the Michigan Court of Appeals affirmed the convictions of Tammy Ann Sauro for Embezzlement between $1,000 and $20,000 from a Vulnerable Adult, but remanded the case for resentencing. In a case tried by Jim Metz before the Hon. David J. Reader in February of 2005, Sauro was convicted by a jury and sentenced to prison as a Fourth Habitual Offender. The appeal was prosecuted by Bill Vailliencourt.
On March 27, 2007, the Michigan Court of Appeals affirmed the convictions of Keith Allen Tackett for four counts of Second Degree Criminal Sexual Conduct. In a case tried by Miriam Cavanaugh before the Hon. Stanley J. Latreille in July of 2005, Tackett was convicted by a jury and sentenced to serve 40 months - 15 years in prison. The appeal was prosecuted by Bill Vailliencourt.

On March 15, 2007, a Circuit Court jury found John Aldon Corrion guilty of Solicitation to Commit Murder for an incident on September 7, 2006 while he was incarcerated in the Livingston County Jail. Corrion was sentenced to serve 21 years and 10 months to 40 years in prison as a Second Habitual Offender on April 26, 2007 by the Hon. Stanley J. Latreille. The case was prosecuted by Pam Maas.

On March 1, 2007, the Michigan Court of Appeals affirmed the conviction of Ronald Ray Creager II of Possession of Marijuana - Second Offense. In a case tried by Pam Maas before the Hon. David J. Reader in June of 2005, Creager was convicted after a bench trial and sentenced to serve 3 days in fail. The appeal was prosecuted by Bill Vailliencourt.
On March 1, 2007, a District Court jury found Erica Lee Turchin guilty of Operating While Impaired and Failing to Report an Accident for an incident in Hartland Township on December 10, 2006. The case was prosecuted by Jim Metz.
On February 22, 2007, a Circuit Court jury found Kenneth Green guilty of Third Degree Criminal Sexual Conduct for an incident on November 8, 2006 in Putnam Township. Green was sentenced to serve a sentence of 5 - 30 years in prison as a fourth habitual offender by the Hon. Stanley J. Latreille on May 10, 2007. The case was prosecuted by Pam Maas.
On January 30, 2007, the Michigan Court of Appeals affirmed the convictions of Andrew Neil Dobek of multiple counts of First and Second Degree Criminal Sexual Conduct, as well as Assault with Intent to Commit Penetration. In a case tried by Pam Maas before the Hon. David J. Reader in May of 2005, Dobek was convicted by a jury and sentenced to serve 25 - 40 years in prison. The appeal was prosecuted by Bill Vailliencourt.
On January 17, 2007, a Circuit Court jury found Sherry Gail Pietryga guilty of Assault With Intent to Cause Great Bodily Harm for an incident on April 19, 2006 in Tyrone Township. Pietryga was sentenced to serve a sentence of three years probation with the first six months in the Livingston County Jail by the Hon. Stanley J. Latreille on February 12, 2007. The case was prosecuted by Dan Rose.
On January 9, 2007, the Michigan Court of Appeals affirmed the conviction of Cedric E. Baiz for Second Degree Criminal Sexual Conduct. In a case tried by Pam Maas before the Hon. Stanley J. Latreille in March of 2005, Baiz was convicted by a jury and sentenced to serve 18 months - 15 years in prison. The appeal was prosecuted by Bill Vailliencourt.
