Permit Transfer Procedure & Application

Residential Soil Erosion Control Permit transfers are completely voluntary. The site must be in compliance with the Provisions of Part 91 of Act 451 as Amended, and any outstanding fees owed must be paid prior to processing the transfer.

The following is a summary of the steps for transferring a Residential Soil Erosion Control permit:

The Current Permittee completes a transfer application including obtaining the New Permittee/Owners information and signature. The signatures of both parties need to either be witnessed by our staff or by a Notary Public. The Current Permittee (Builder) then submits the transfer application. If the transfer application is not complete, it will not be accepted.

The LCDC inspects the site to verify compliance with the Provisions of Part 91 of Act 451 as Amended.

If the site is not in compliance, a notice of “Rejection/Violation” will be posted at the site. A $65.00 fee will be charged to the builder for each re-inspection required prior to approval of the transfer. The transfer will be rejected and the builder will remain responsible if the site is not brought into compliance.

If the inspection passes, an approved notice will be posted, and the transfer processed.

Once the transfer is processed, the New Permittee/Owners will assume responsibility for all future erosion and sedimentation controls. Any other additional inspections required will be subsequently billed to the New Permittee/Owner at the end of the project.

Permit transfers should be used to transfer responsibility to the new owner if the property is sold before permanent stabilization can be achieved, and both parties are in agreement.
